What is a section 20 notice, & how can we help?

A Section 20 notice is a legal notice that a landlord or property management company must serve leaseholders before carrying out specific major works or entering into certain long-term agreements.

Under the terms of the Landlord and Tenant Act 1985, a Section 20 notice is required for any work or contract that is expected to cost more than £250 per leaseholder. This includes significant repairs, maintenance, or improvements to the building and arrangements for services such as cleaning or gardening.

The purpose of the Section 20 notice is to allow leaseholders to comment on the proposed work or contract and to nominate contractors or service providers. Leaseholders have 30 days to respond to the notice and provide comments and suggestions. If they do not respond within this time, the landlord or property management company can proceed with the work or contract as planned.

Failure to comply with the requirements of a Section 20 notice can result in legal action against the landlord or property management company, and the costs of the work or contract may not be recoverable from the leaseholders.
